Our practices comply with all applicable U.S. laws and requirements. We are located in the United States and this is a U.S.-based website, hosted in the US-based physical data center. As we continue to develop our website and take advantage of technologies to improve the services we offer, this policy likely will change. Privacy Shield Framework Privacy Statement: –

The Federal Trade Commission (FTC) has jurisdiction over Zenwork, Inc’s compliance with the Privacy Shield. However, Zenwork adheres to the Swiss-U.S. Privacy Shield Frameworks. We follow the Privacy Shield Principles published by the U.S. Department of Commerce (the “Principles") with respect to all such data. If there is any conflict between the policies in this privacy policy and the Principles, the Principles shall govern.

Zenwork shall ensure that the information which is disclosed subscribes to the Principles and are subject to law providing the same level of privacy protection as required by the Principles.

Can I Change My Information?

You may change or update your personal information by logging in to your account. You will have Individual access to your account. If for some reason you are unable to change your personal information online, you may email a request to support@fidentity.com for further assistance.

Security

We have taken certain physical, electronic, contractual, and managerial steps to safeguard and secure the information from loss, misuse, unauthorized access or disclosure, alteration or destruction which we collect from site visitors. Although information sent to and from us is secured according to industry best practices, we cannot guarantee the security of Information on or transmitted via the Internet. We shall take reasonable steps to protect the Information.

Data Protection

Zenwork processes only that Information which is relevant for the purpose for which it was collected from the customers. We ensure that the Personal Information is accurate, Complete and reliable for its use. Zenwork shall only put in use the personal information collected, in a way that is consistent and pertinent with the purpose for which it was collected. Zenwork will take all steps that is reasonable to ensure that the information collected is accurate, reliable and complete for its use. Endeavours will be made by Zenwork to ensure that the information collected is accurate, reliable and complete for its use.

Fidentity may store and process inputs processed by the service solely to provide and maintain the employee and visitor access and attendance management, a client using Fidentity platform may allow their employees/visitors to opt-out.

Fidentity customers own and retain the rights to use of their content. We do not use any personally identifiable information that may be contained in customer content to target products, services, or marketing to the Fidentity customers, affiliates, or their end-users.

Customer trust, privacy, and the security of our customer content is our highest priority and we implement appropriate technical and physical controls, including encryption at rest and in transit, designed to prevent unauthorized access to, or disclosure of, your content and ensure that our use complies with our commitments to our customers. Customers may allow their employees and/or visitors to opt-out of having their image used to touchless employee attendance and visitor management functions.

  • Q: Can Fidentity customers delete the image and associated data from the Fidentity platform?
    A: Yes. Customers control the data storage and deletion and they can directly delete the image and other data associated with their  account by logging in to the Fidentity account established for them.
  • Q: Who has access to customer content that is processed and stored by Fidentity?
    A: Only authorized employees and customer authorized administrators will have access to their content that is processed by Fidentity platform. Your trust, privacy, and the security of your content are our highest priority and we implement appropriate and sophisticated technical and physical controls, including encryption at rest and in transit, designed to prevent unauthorized access to, or disclosure of, your content and ensure that our use complies with our commitments to you.
  • Q: Who owns the content that is processed and stored by Fidentity?
    A: Customers always retain ownership and control of their content and the Fidentity platform will be used to accomplish employee touchless attendance and visitor management business use cases.
  • Q: Can Fidentity be integrated with websites, programs or other applications that are directed or targeted to children under age 13 and subject to the Children’s Online Privacy Protection Act (COPPA)?
    A: No.

Compliance

We evaluate our privacy policy periodically, to make sure that the policy is accurate and comprehensive with regard to the information intended to be covered and accessed ,and is confining with our principles.

General Data Protection Regulation (GDPR) Basis

Zenwork collects and processes your personal information only if it is provided by you. As per the GDPR, we can process your personal data legally only with your consent, which is referred to as “Legitimate Interest” which means that, you have provided your personal data with your own interest to us to either provide a service from our site or to contact you using the details you have provided. As per GDPR, the legal basis for processing personal information is contractual obligation. Therefore, we process customer’s personal data only if they have provided the data to Zenwork.

Our Policy for Children

We do not direct the site to, nor do we knowingly collect personal information from, children under thirteen, unless children information is included part of required tax reporting for the various agencies.

Transfer of personal Data Internationally

As per Chapter 5 of General Data Protection Regulation, we shall inform you if we transfer or intend to transfer your information which we hold on you to countries outside the USA. The information that you will provide us may be transferred to and maintained on computers/servers located outside of your state, province, country or other governmental jurisdiction but will be always under strict conditions of confidentiality. We have taken steps to ensure that our subsidiaries and those who process data on our behalf enter into the standard contractual clauses approved by the European Commission, to safeguard the personal information which is transferred to and from the EEA and beyond. If you are located outside the United States and choose to provide information to us, Zenwork transfers personal information to the United States for processing. Your submission of such information represents your agreement to that transfer.

The site may contain links to third-party websites, which may have privacy policies that differ from our own. We are not responsible for the activities and practices that take place on their sites. The fact that we link to another site is not an endorsement, authorization or representation of our affiliation with that third party, nor is it an endorsement of their privacy or information security policies or practices. We do not exercise control over third party sites. Accordingly, we recommend that you review the privacy policy posted on any site that you may access through our site.

How long my information is saved?

We will retain your personal information only for the time necessary to provide the Services we perform for you, or stated by the purposes outlined in this Privacy Policy which is 3 years.

  1. will continue to ensure the privacy, security and confidentiality of the Personal Data;
  2. will not Process the Personal Data further except to maintain it for 3 years and securely store it for at least one year in archive;
  3. will continue to comply with its obligations under its Agreement with the customer;
  4. will securely Delete the Personal Data immediately after Zenwork’s duty under Applicable Law to retain it expires.
